摘　　要：如何有效防止公职人员因利益冲突而引发腐败是当前各国面临的难题。而法律由于具有惩防腐败的双重作用而成为破解这一难题的锐利的武器。目前,建立健全防止利益冲突法律制度已经成为跨民族、跨意识形态的反腐败举措。虽然我国在建立防止利益冲突制度方面也进行过探索,但由于大多停留在党纪、政纪层面,加之监督和执行机制不完善,起的作用有限。本文在审视国际社会防止公职人员利益冲突立法和总结我国的相关实践与探索经验的基础上,提出建议:既然制定防止利益冲突法已成为国际惯例,为与《联合国反腐败公约》接轨及适应当前的预防腐败的急迫需要,应由全国人大制定一部专门的《防止利益冲突法》,这样可以和我国公务员法、刑法、刑事诉讼法等互为补充,从而形成一个立体式预防腐败的法律体系。Currently it has been a worldwide challenge how to effectively prevent civil servants from corruption caused by interest conflicts. Law, which plays a dual role in corruption prevention and punishment, turns out to be powerful weapon to cope with this problem. At present, establishing a legal system of preventing interest conflicts has become a significant anti-corruption measure beyond national and ideological boundaries. Though China has done some explorations in establishing a system to prevent interest conflicts, these attempts only achieve little effects because most policies are confined to the level of party and political disciplines, and not strictly supervised and enforced. Base on the study of international legislation on preventing civil servants from interest conflicts and the summary of China＇s related practices and explorations, this article suggests that since legislation on preventing interest conflicts has become an international practice, the NPC should enact a special Law on Preventing Interest Conflicts to correspond with the United Nations Convention against Corruption （UNCAC） and satisfy the urgent needs of corruption prevention. In this way, It can supplement the Civil Servant Law of the PRC, the Criminal Law of the PRC and the Criminal Procedure Law of the PRC, etc. , and contribute to establishing a stereo legal system for corruption prevention.
