摘 要:劳动犯罪与劳动相伴而生,刑法对劳动犯罪的规制是保障国家劳动管理体制正常运行的最后一道防线,劳动犯罪的刑罚承担着实现刑法价值和劳动法价值的双重使命。我国现行《刑法》对劳动犯罪的刑罚配置上仍存在侧重科处自由刑而轻视罚金刑、对单位劳动犯罪的罚金额度规定不明确、劳动领域渎职犯罪的处罚轻于其它劳动犯罪的处罚、劳动犯罪的资格刑处罚空位等不足,故应在坚持刑罚的相应性和比例性原则的前提下,充分借鉴域外立法的有益经验,在劳动犯罪的刑罚轻缓化、罚金刑、资格刑、单位犯罪等方面完善刑罚配置。Labor crime is born with labor, and the regulation of criminal law against labor crime is the last line of defense to protect the normal operation of national labor management system. The punishment of labor crime bears dual mission of realizing values of criminal law and labor law. There is deficiency of criminal penalty configuration for labor in China's current“Criminal Law”, such as paying more attention to freedom punish-ment than fines punishment, unclear regulations of fines amount for unit labor crime, punishment for malfeasance crime lighter than other labor crimi-nal penalty in the field of labor dereliction, and lack of qualification penalty of labor crime, so under the premise of adhering to the principle of corre-spondence and proportionality of penalty, we should fully draw on the useful experience from extraterritorial legislation to perfect penalty configura-tion of labor crime in penalty mitigation, criminal fine, qualifications penalty and unit crime.
