摘　　要：文章根据一个案例分析了实践中常见的一种交通事故致人损害的情形,认为它既不同于好意同乘,也不同于公路客运合同,并将其命名为准好意同乘的行为。本文分析了对这种情形致人损害时的责任承担,并提出相关立法建议。A common case of personal injury in a traffic accident is analyzed herein in which the behavior is named consent for taking a ride by quasi kindness because it differs from consent for taking a ride just by kindness or from the contractual road passenger transportation. It is analyzed of taking lia-bilities of personal injury in this situation and put forward legislative suggestion thereof.
