摘　　要："乡镇长直选案"反应了社会转型时期我国现阶段基层民主制度供给的缺失。该问题主要是源于市场化进程中社会利益的日趋多元化,人民民主意识不断高涨,特别是基层民主诉求尤为强烈,而制度规范的局限性却未能给人民的民主诉求提供应有的制度供给,从而导致了现实发展与现有制度之间的矛盾,因此如何建立法律保障体系确保基层民主制度供给,使其在法治化环境下保障基层自治有序发展,使得基层自治权得以充分实现,保障基层民主的发展和进步就显得更为必要。＂The Town Mayor Direct Election Case＂ reflects the lack of supply of the democratic system at the grassroots level in China at the present stage of social transformation. It is mainly caused by the diversification of social interests in the process of marketization. Peopleg democratic consciousness is rising continuously, especially the strong grassroots democratic appeal, while there lacks the appropriate system due to the limitations of the sys- tem, which leads to the contradiction between present development and the existing system. So it is essential to fig- ure out how to establish the legal protection system to ensure the supply of grassroots democracy, in order to ensure the orderly development of grassroots autonomy in the legal environment, to fully realize the grass - roots autonomy and to ensure the development and progress of grassroots democracy.
