摘　　要：大学章程是大学自治的根本法律依据。通过追溯1650-1780年哈佛学院以特许状为法律渊源而衍生的大学章程体系的初期发展,探讨了以哈佛学院特许状及监事会章程为源头的早期大学章程的历史地位和作用。特许状赋予了哈佛大学的法人地位,监事会章程及相关法案不断调整和完善监事会和院务委员会的权力分工,形成了哈佛大学监事会和院务委员会共同治理的管理传统,奠定了大学章程在大学治理结构中的宪章地位,保障了哈佛大学的学术自治。The rules and bylaws of university is the legal basis of university autonomy. By tracing the early development of Harvard Charter and bylaws from 1650 to1780, this article discusses the history and its important role of the early rules and bylaws originating from the Harvard Charter and rules of the Board of Overseers. Harvard Charter is the legal basis of Harvard College. The rules and acts decided how authority and accountability were delegated as well as how ownership was divided between the Board of Overseers and Harvard Corporation, which shaped the co-governance tradition of Harvard Universityts two governing boards, established the position of charter status in university governance structure and played a very important role in protecting academic autonomy of Harvard University.
