“可持续发展的投资政策框架”与我国的对策

摘　　要：联合国贸易和发展会议(UNCTAD)制订的"可持续发展的投资政策框架"(IPFSD)产生的主要背景是传统国际投资政策本身面临严峻的挑战和南北国家的国际投资地位发生显著变化。IPFSD的主要创新表现在从"偏重保护外资权益"到"促进东道国可持续发展",从"偏重保护外资"到"平衡当事双方权利义务",保护外资和管制外资从"各行其道"到"一体化"三个方面。我国的立场和对策应当是:促进形成共识,支持UNCTAD制订"可持续发展友好型"BIT范本;建立和健全基于IPFSD的我国海外投资法律制度;及时制订我国"可持续发展友好型"BIT范本,积极开展相关实践。The main background of Investment Policy Framework for Sustainable Development （IPFSD） formulated by UNCTAD is that traditional international investment policy itself faced severe challenges and the international investment status of countries from the North and the South has changed drastically. What is new in IPFSD is reflected in three as- pects ： from ＂undue protection of rights and interest of foreign investment＂ to ＂promotion of sustainable development of the host country＂; from ＂undue protection of foreign investment＂ to ＂balance of rights and obligations of two parties involved＂; and from ＂each going its own way＂ to ＂integration＂ in the ＂protection of foreign investment＂ and ＂regulation of foreign in- vestment＂. It is suggested that China should promote the formation of an international consensus on the concepts of ＂sus- tainable development＂, ＂balance＂ and ＂integration＂. It should support UNCTAD to work out a ＂sustainable development- friendly＂ （SDF） model BIT, set up and improve its legal system for overseas investment based on IPFSD, and also formu- late its SDF model BIT as early as possible and actively put them into practice.
