变性人变性信息的隐私权保护与限制

摘　　要：变性人由于性别特殊,他们的隐私权保护有别于一般的自然人。为有效保护变性人的隐私权,应当区别变性信息和性别信息,将变性信息纳入隐私的范畴,作为隐私权保护的客体之一;同时,确定变性人变性信息隐私权保护的若干重要规则,包括规范医院、媒体以及变性人利害关系人对变性信息的保密,对作为公众人物的变性人的隐私权进行适当限制以及基于正当理由对变性人的变性信息予以公开等具体规则。Because of the special sex, protection of privacy of transgenders＇ is different from that of the general natural person. In order to effectively protect transgenders＇ privacy, it should make a difference between transsexual information and sex information, and the transsexual information should be included into the category of privacy as one of the object of privacy. At the same time, some important rules about protection of privacy of transgenders＇ transsexual information should be determined, including the formulating of the hospital, media and interested parties to keep the transsexual information secret, the limitation of the privacy of the transgender appropriately as a public figure, and the publicity of the transgenders＇ transsexual information based on legitimate reason and so on.
