我国口头遗嘱要件规则重构探析

摘　　要：口头遗嘱是我国《继承法》规定的一种遗嘱形式,但目前《继承法》规定的口头遗嘱要件规则仍存在一些明显不足,需要从明确界定"危急情况"的具体法定情形,明确规定口头遗嘱制作标准、程序和有效期限,建立口头遗嘱备案和检验(认定)制度以及扩大见证人资格的排除范围等方面进一步完善我国口头遗嘱法律制度,以满足人们多元化生活方式的需要。Some obvious defects exist in rules of essential elements for Nuncupative will, a kind of will regulated in Chinese Inheritance Law; therefore we need to clearly define the specific legal circumstances in emergency situations, the standards of making nuncupative will, the procedures and the term of validity, to set up the record and testing （identifying） systems for nuncupative will, and to widen the exclusion scope of eyewitness＇ qualification. In this way, we can further perfect our legal system for nuncupative law to meet the needs of people＇s various ways of life.
