摘 要:国资委是中国社会在经济领域分权的产物,在现有法律框架内,它肩负着监督与管理等诸多职能。这些职能的设置本意是为了国有资产的保值增值与又好又快地发展,但是,无论是从国有企业实际营运层面还是从法理分析角度来看,它们设置得是否妥当值得研究。在社会进一步分权的背景下,面对竞争性与非竞争性国有公司治理的客观需求,国资委在厘清自己的身份属性后,应主动地克服制度或者非制度性因素的羁绊,遵循分权与制衡的原则,理性地实现职能转换。SASAC is a result of economic decentralization in China. It is assumed by regulation and supervision in order to protect and develop state -owned assets in a legal framework. However, from an actual performance of state- owned company standpoint or from a Legal analysis of function perspective, whether SASAC Function is established prop- erly should be studied. Facing the factual need of competition and non -competition of state - owned company governance, SASAC should actively overcome the yoke of institutional and non- institutional factors, abide by the principles of separation of powers and checks and balances, and achieve the change of function after sorting out its identity in the contest of Social Decentralization.
