摘　　要：学生体育权利指学生在从事体育活动时所享有的受益资格、行为及意志的自由支配以及权益受侵害时获得法律保障的可能,是学生最基本、最重要的权利之一。作为保障学生健康的体育权利研究虽有较大进步,但作为保障学生体育权利最后防线—法律救济制度却甚少研究。文章试图对学生体育权利法律救济制度进行法学层面的剖析,以指出我国学生体育权利法律救济存在的问题,并对完善学生体育权利法律救济制度提出建议。Students＇ Sports Rights refer to students＇ enjoyment of the beneficiary eligibility, behavior, free will and the possibility of the infringed fights and interests being protected by law when engaging in sports activities, which may be the most basic and important fight of students. As a safeguard of students＇ health, the study of sports fights has a great progress, but for protecting students＇ sports rights, there is little research on the legal remedies which can be regarded as the last defender. The paper attempts to analyze the legal relief system of students＇ sports fights from the legal aspects in order to point out the problems existed in the legal remedy of student sports fights and make recommendations to improve the legal remedy system of students＇ sports fights.
