我国土地承包经营权入股的制度选择及完善

摘　　要：以我国土地承包经营权入股制度为视角,对我国土地集体所有制度与土地流转自由之间的根本矛盾以及制约农地股份合作社发展的因素进行分析,发现我国农地入股合作社存在相关法律制度不完善、管理制度执行不到位等问题,并且受到区域发展不平衡、城乡二元制结构以及农村社会保障制度水平的影响。提出需要完善相关因素以更好地发展农地入股合作社制度,保障农民合法权益。The contradiction between the collective ownership of land and free land transfer makes rural cooperatives the more practical system selection of becoming a shareholder of rural land contractual management right in China. There are some problems for the land shares cooperatives that the related legal system is not perfect and the management system is not in place. Moreover, the development of coopera- tives is affected by the imbalance of regional development, the urban-rural dual structure and level of rural social security system. The relevant factors should be improved in order to better develop the agricultural land shares cooperative system and safeguard the rights and interests of farmers.
