摘 要:20世纪以来,缘于实证行政法学的冲击,公法学界开始有意冷落概念行政法学。但是,这并不是概念行政法学本身的缺陷所致,而是因为我们现在并不具有使用这一方法的能力。实际上,概念行政法学具有实证行政法学所欠缺的对价值的评估方法,而实证行政法学却存在着用对物体的认识手段研究"人"的根本错误,因而,概念行政法学理应得到重估和重用。譬如,将其运用在"应受行政处罚行为成立要件"主题上,我们便可获得一个逻辑闭合、体系严谨的理论框架。Since the 20th century, due to the impact of empirical administrative jurisprudence, administrative law scholars began to leave out conceptual administrative jurisprudence intentionally, which isn' t due to intrinsic defects of conceptual administrative jurisprudence but scholars have no ability to use this method. In fact, conceptual administrative jurisprudence has a method to assess value that is lacking in empirical administrative jurisprudence while empirical administrative jurisprudence has a fundamental fault that it often applies some appraisal tools suitable form things to people. Therefore, conceptual administrative jurisprudence should be revaluated and reused. For example, if it can be applied to the research of constitution of administrative illegal action, we could obtain a theoretical framework with a closed logical and rigorous system.
