大学章程与大学内部治理--基于英国、意大利大学章程建设的考察报告

摘　　要：英国和意大利大学章程在大学发展、改革和形成现代大学制度中发挥了十分重要的作用。章程是大学自治的法律基础,是大学治理的制度保障,是大学成员行为的基本规范,同时也是社会监督大学的重要依据,章程体现了不同大学治理模式。我国高校改革和现代大学制度建设应积极学习借鉴英国、意大利大学章程建设的经验,把大学章程作为现代大学制度建设的核心,理顺政府与大学的关系,完善大学内部治理结构,推进教授治学与民主参与制度建设,同时要彰显学校特色。University charters have played an important role in the development and reform of universities in the UK and Italy. University charters are the legal basis of university autonomy the structural guarantee of university governance, the code of conduct of university members as well as important benchmarks for monitoring the running of a university. University charters also reflect difference governance models. The experiences of university charter drafting of the British and Italian universities can shed some light on the reform of Chinese universities and building modern university gove modern university governance structure, defining ruance structure, such as making university charters the core of a the relationship between governments and universities, improving the internal governance structure, promoting the engagement of professors in teaching and democracy in university governance and meanwhile, increasing the visibility of the defining strength of the universities.
