论离婚案件中夫妻共有股权的分割

摘　　要：夫妻共有股权不同于传统的夫妻共有财产,传统的夫妻共有财产以单一财产属性的物品或权利为标的,在离婚案件中容易进行分割,在审判实践中也少有争议。夫妻共有股权具有权能的综合性、股权分割的涉他性和股权价值的巨大波动性,其分割涉及婚姻法和公司法的规定而变得复杂,也是近年来人民法院审理离婚案件遇到的新难题。结合夫妻共有股权的多重属性分析了一人公司、普通有限责任公司和股份有限公司夫妻共有股权的具体分割。The marital joint stock right is not the same as the traditional marital joint prop- erty. The items with simple property nature are easy to divide in the divorce case,which have less disputes in practice. The marital joint stock right is more comprehensive, more related to others and the value is more changeable. The practice of division concerns taw of marriage and company law,which makes it even more complicated. It is a new problem in the divorce case in recent years. The concrete case of marital joint stock right, LLC and CO. ,LTD, is analyzed considering the multiple properties.
