从国际信息公开领域新变化审视我国信息公开制度

摘　　要：近年来国际信息公开领域发生了一些新变化。信息公开法律模型从原先的以被动公开为主转向如今的以主动公开为主。信息公开促进机构从以前仅关注信息公开法律的推广,到现在开始致力于信息公开法律的实施成效,并建立了分析信息公开制度实施的若干模型。信息公开法律的实施也呈现出依法和依服务两种不同方式。我国通过了以主动公开为主的《信息公开法》,它对旧有的信息公开制度实施分析模型提出了挑战,信息流通模型应运而生。但是因为我国目前采取了依法方式的信息公开制度实施策略,阻碍了我国信息公开制度实施成效的发挥。New changes have taken place in the international information disclosure field in recent years. The legal model of information disclosure has changed from the previous emphasis on passive disclosure to the current emphasis on active disclosure. The information disclosure promotion organizations only paid attention to the popularization of information disclosure law in the past, however, they have started to commit themselves to the implementation effect of information disclosure law at present, and have constructed several models to analyze the implementation of information disclosure system. Two different ways of depending on law and depending on service have emerged in the implementation of information disclosure law. An information disclosure law emphasi- zing on active disclosure has been passed in China. It challenges the previous information disclosure system implementation and a- nalysis model. Information flow model arises at the historic moment. However, as China has adopted the information disclosure sys- tem implementation strategies of depending on law at present, giving the information disclosure system implementation effect into full play has been impeded.
