摘 要:"经租房"是我国典型的土地历史遗留问题。建国初期,国家制定政策,对符合条件的城市私有住房由国家统一经租给无房户使用,并支付适当租金。因当时国家政策未明确"经租房"权属是否转移,这导致当前在法院、土地管理部门以及"经租房"主之间出现了权属之争。鉴于司法机关普遍采取回避态度,而行政机关又囿于角色和地位的局限而难有作为,国家应当采取政治解决途径,为"经租房"主提供合理的诉求渠道,有针对性地考量,以维护社会和谐稳定。The "rented houses" is a typical problem left over by history in the process of land management. During the early years of the People's Republic, the state made policies to rent out certain urban private houses to the homeless who paid rents to the owner. Since ownership transference was not clarified then, disputes over ownership now often arise among the court, land management and the former owner. In view of the judiciary's shunning and the administrative orgaffs limited roles, the state should, via political solution channels, pertinently consider the reasonable appeals of the "rented houses" owners to maintain social stability and harmony.
