摘  要:目前,无论是国家层面的立法还是地方的物业管理政策规定,均将制度约束重点定位于居住类物业管理。针对涉及利益群体复杂的非居住物业管理尚缺乏有针对性的制度约束。这就导致了非居住物业管理纠纷不断产生,难以调解。从居住物业管理与非居住物业管理的差异性入手,在上海市场调研的基础上,总结分析了非居住物业管理中较为典型的问题和纠纷,并从业主自治体系、服务制度、物业使用与维护三大模块提出了化解矛盾的法治路径。At present, either at the state or local level, rules are focusing on residential property management. Facing the non - residential property management which is involved in complex interest groups, we lack of system constrains, which is result in disputes continuously produce and difficult to media- tion. On the basis of market research in Shanghai, this essay begins with the difference between residential property management and non - residential property management, summary and analysis the typical disputes in the non - residential property manage- ment. In the end, this essay points out the disputes resolution under the rule of law path from three big modules, which are the owner autonomous system, service system and use and maintenance property system.
