摘　　要：分析了影响特许经营合同重新谈判的因素,结合案例剖析了当前我国城市水业特许经营合同重新谈判频繁发生的原因,提出了建立包含准入制度、监管体系、投资回报机制、风险分担机制、重新谈判机制和项目移交机制的特许经营制度体系,并探索了土地资产与附着于其上的水务固定资产分离的特许经营模式。This essay analyzes the factors that affect concession contracts renegotiation theoretically. Then based on some cases, this essay explores what has caused the high incidence of concession contracts renegotiation in Chinese urban water industry. An institution framework including access system, regulation system, capital return mechanism, risk - share mechanism, renegotiation mechanism and program transfer mechanism has been proposed to guarantee the concession contracts working functionally. In the end. the oossibilitv of separating land property from water fixed assets attached is discussed.
