摘 要:究其本质而言,坚持党的领导与司法自主之关系属于政治与司法的关系问题。由于坚持党的领导与司法自主存在所追求合法性内容的不同,其关系存在紧张乃至抵牾的可能。在我国处于转型时期的当下,由于党对合法性资源的追求处于不断变化的过程中,在处理坚持党的领导与司法自主方面出现了"泛政治化"、"去政治化"两种不良趋向。在法治框架下,构建坚持党的领导与司法自主之良性关系,需要同时进行政治法治化、司法技术化,使得司法在党的领导下复归其本源特性。In the essence, the relation between party~ leadership and judicial independence belongs to the issue of the relation between politics and judiciary. There exists the possibility of tension since party's leadership and judicial independence focus on two different kinds of legitimacy. On the contemporary transitional China, since the process of the party's pursuing legitimacy is flexible, there are two trends of "pan politician" and " depolitician" dealing with the relation between party's leadership and judicial independence. Under the constitutional framework, in order to shape the good relationship between party~ leadership and judicial independence, we need simultaneously precede the process of political legalization and judicial technicalization. Only by that can the judicial return to its original system under the leadership of the party.
