公民素养、政府保护性功能与城市社区自治

摘　　要：住房商品化后,公民政治参与诉求随房产权益的出现而增加。学界认为商品房业主维权有利于公民性的增长和公民社会的形成,是社区自治水平提高的表现,只是目前我国基层政府对城市社区自治干预过多,居委会和物业公司也会阻挠业主委员会的成立,使社区自治面临困境。但值得注意的是,通过维权冲突的方式得出公民性的成长或公民社会的形成的结论有待商榷,因为那只是一种比较特殊的状态,并且冲突本身就有利于群体凝聚力的增加。因此,社区自治不能忽视常态下群体内部冲突,城市居民能否理性化解社区矛盾与冲突才是社区自治能否成功的关键。本文通过一个具有代表性的案例表明,城市社区自治主要依赖于公民素养,其次是政府的保护性功能。公民素养是社区自治的灵魂,政府保护性功能是社区自治的基础,规范的住房市场秩序即物业公司与业主利益的合理界定是社区自治的物质基础,三者相互配合才能形成社区良序。无论如何,社区自治仅靠道德无法持久,只有依赖公民提高素养,依靠政府的保护性功能惩戒违规者,依赖社会道德规范形成舆论压力,明确与物业公司的权益分配,才能达到良好的城市社区自治。After housing commercialization, citizen political participation demands increase as the property rights appear. The academics think that safeguarding the commercial housing owners' right is conducive to citizen's growth and the formation of citizen social, reflects the community autonomous level improving, but at present our country city community autonomy of the local government over intervention, Resident's committees and property companies will obstruct the establishment of the Commission owners, which made the community autonomous dilemma. Some scholars conclude, which through a lot of cases study, it is possible in middle community to maintain social order by moral. However, there are still some problems. It is notable that, the conclusion of citizen growth or civil society by the rights conflict way is questionable, because it is only a special status, and the conflict itself increased group cohesion. Therefore, community autonomy can not ignore group internal conflict under normal conditions. If city residents can rationally settle community contradictions and conflicts which is the key to the success of community autonomy. In this study, through a typical case shows, city community autonomy depends mainly on the civic literacy, followed by the protective function of the government. Citizenship is the soul of community autonomy, government protective function is the base of community autonomy, the regulated housing market order, the reasonable definition of property company and housing owners right, is the material basis of community autonomy, the three parties work together to form a community order. In any case, the community autonomous can not be sustained if only depending on the morality, it should rely on that citizen literacy improving, on the protective function of government punishment violators, on social morality norm formation pressure of public opinion, the autonomy level improving in the civic literacy. To achieve the good city community autonomy,it should be clear on the company's property
