论住宅专项维修资金管理中的政府管理与公民自治

摘　　要：住宅专项维修资金作为社会保障体系的一部分,涉及的利益关系复杂,关系到业主、开发建设单位、物业服务公司、使用人等多方主体的利益。对该笔资金的管理,从本质上讲虽然属于业主自治的范畴,但我国目前的社会治理结构中公民自治并不成熟,没有政府的有力介入,局面会混乱不堪。所以,该笔资金的管理需要有效结合政府管理与业主自治,即在政府的监管下,需要业主自治组织的成熟与发展,需要专业社会组织的帮助。Housing maintenance funds is a part of social security system and involves complex parties of interests. The management of the funds belongs to the scope of citizen autonomy, which, however, is much underdeveloped at present in china. The management of the funds will probably be failed without government ad- ministration, while too much interference from the government may not solve all the problems. The paper thus proposes a combined effect of government administration and the gradual maturity of citizen autonomy
