摘　　要：创业投资是一种高风险、高回报的投资活动,它的健康发展需要有严密的法律监管机制作为保障。国务院《创业投资企业管理暂行办法》自2005年公布实施以来,我国创业投资企业蓬勃发展。但是,由于有关创业投资监管的立法粗疏,也在实践中滋生了一些问题。为促进创业投资行业的持续发展,我国需要制定统一的创业投资企业法,并采取一种以政府监管为主、行业监管为辅的外部监管模式,将对创业投资基金的监管扩张至基金投资人、基金管理人、基金托管人和基金运行过程等各种对象和各个环节。Venture capital is a kind of high risk, high return investment activities, its healthy development requires legal regulation mechanism closely as security. The 'Interim Measures for the administration of venture investment enterprises' since it was unveiled in 2005, China's venture investment enterprise vigorous development. However, because the legislation of supervision to venture capital, also caused some problems in practice. In order to promote the sustainable development of the venture capital industry, our country need venture capital enterprises to formulate a unified, external supervision mode and adopt a kind of government regulation, industry supervision as complement, the venture capital fund regulatory expansion to fund investors, fund managers, fund entrusted process and fund operation of various objects and links.
