摘　　要：动植物检疫失职罪属于监管型渎职犯罪的一种具体犯罪。本罪的客体为单一客体,是指对动植物检疫机关正常活动的侵害。本罪实行行为的表现形式为不作为。本罪因果关系要根据动植物检疫失职行为对危害结果所起作用大小是否达到追究刑事责任的程度来进行判断。本罪主体是特殊主体,包括动植物检疫机关的检疫人员和其他负有动植物检疫职责的人员。本罪主观方面只能是过失,不包括间接故意。The crime of neglect of duty in working at animal and plant quarantine is one of supervisory crimes of dereliction of duty. The object of the crime is the regular system of quarantine of animal and plant. The crime is also a crime which acts by a nonfeasance manner. The causal relationship of the crime depends on the affections of the manner of the officials in working at animal and plant quarantine with the harmful results. The subject of the crime is any functionary of a state organ who is responsible for quarantine of animal and plant and the other persons who also have the responsible for quarantine of animal and plant. The subjective aspect of the crime is just negligence, and it can＇t be indirect intent.
