摘　　要：议会监察专员是源于北欧的一种特殊的宪政制度,监察专员拥有法定职权和独立地位,接受公民投诉,调查官员违法,发布处理意见。对于公民而言,他是人权的保护者;对于政府来说,他是管理的督促者;对于议会而言,他是法治和民主的参与者。议会监察专员的设立与运行,有力地促进了欧洲善治进程,对中国法治发展亦极具借鉴意义。The restitution of the Ombudsman originated in North Europe where the Ombudsman enjoys the legal authority and remains independent. The Ombudsman could receive maladministration complaints from citizens, make inquiries and investigate maladministration and issue the critical re- marks. The Ombudsman serves as the protector of the human rights for the citizens, as a kind of supervi- sors of the public administration for the government, as the participants of the rule of law and democra- cy. The Ombudsman strongly promotes the rule of law and good governance of European society, which could offer references for China.
