摘　　要：身份证是政府公权力介入颁发的对公民进行身份识别和身份证明的证件。在大数据时代,身份证的身份识别与身份证明功能越来越强大,与之相伴的权力滥用与对个人隐私权的侵害也越来越严重。因此,必须从身份证法律关系的公法属性入手,通过立法明确个人信息相关权利保护的范围和方式,限制身份证权力行使,保护身份证权利,建立起既提高政府社会管理能力、又能保护公民个人隐私权的完善的公民身份证法律制度。ID card is the official document issued by government authorities to recognize and verify citizens＇ identities. In the era of big data, such function of ID card has been more powerful, yet it is accompanied by increasingly serious abuse of power and violation of personal privacy. In this regard, the government should proceed from the public legal attribute of ID card to establish the scope and methods for protecting personal information and other related interests, to limit the exercise of power, and to protect the ID card rights. It also should build the complete legal system for ID card that can both improve the government＇s social governance competence and protect the privacy of individual citizens.
