土地承包经营权入股之法律性质辨析

摘　　要："入股"在土地承包经营权流转中有着不同的内涵,只有入股合作社或公司才有讨论流转法律性质之意义。债权流转说所提出的避免农民失去农地、促进农民收入最大化、现行立法支持等理由均难以成立。物权流转说更能将土地承包经营权塑造成真正独立的用益物权。确立土地承包经营权入股之物权利用形式,实现更加灵活和充分的土地承包经营权流转,才能适应农业国际化、产业化、规模化和现代化之要求。Pooling of rights as shares has different meanings in the circulation of the right to land contractual management, and it＇ s worth discussing the circulation legal nature of the right to land contractual management only under the conditions of pooling of rights of cooperative or company. The reasons given by the creditor＇ s right circulation theory, such as avoiding losing the farmland, maximizing the farmers＇ income, supported by the current legislation, and so on, can hardly be established. The real right circulation theory can mold the right to land contractual management into real independent usufructs. Establishing the utilization modes of real right of the right to land contractual management and achieving more flexible and sufficient circulation are necessary to adapt to the requirement of the internationalization, industrialization, scale expansion and modernization of agriculture.
