地方立法保障学校体育场馆对外开放的思考

摘　　要：学校体育场馆对外开放是世界各国促进群众体育发展的重要举措,有效地弥补了全民健身活动中场地设施的不足,对其进行地方立法是保障地方行政和司法部门执法效力的基本依据,同时有利于国家体育法律和行政法规的有效实施。就我国现有学校体育场馆对外开放地方立法而言,有相当多的省市在全民健身条例、体育场地法规或规章中涉及学校体育场馆对外开放的条款,有些地方还专门就学校体育场馆对外开放制定了规范性文件,但还应建立更全面的立法保障。建议各地在加强学校体育场馆对公众开放立法的同时,更要使立法内容充实而具体,充分突出地方特色,明确学校体育场馆开放的法律责任主体,并且通过立法评估来保证学校体育场馆对外开放地方立法的效力和效果。The school sports facility open to the outside is the national important action to promote the development of mass sports in the world,which has made up the question of facilities insufficiency in the national fitness.The local legislation is advantageous to safeguard local administrative and judicial enforcement effectively and implement the national sports law and the administrative rules and regulations effectively.The national fitness regulations,the sports site regulations or rules in many provinces and cities involve the school sports facility opening to the outside,and some provinces and cities also have formulated specially the normative documents about the school sports facility opening to the outside.On the whole,these local legislations have played the vital role in the school sports facility opening to the outside,and the school sports facility opening to the outside has legal support,but not enough.Therefore,when each region strengthens the legislation for the school sports facility opening to the outside,the legal content must be substantial and specific,and prominent local characteristics,clear the entity of legal responsibility and guarantee the effectiveness and the efficiency of the local legislation that the school sports facilities open to the outside through the legislative appraisal.
