我国图书馆“孤儿作品”利用中的版权问题分析

摘　　要：目前,各国图书馆收藏着大量的"孤儿作品",然而"孤儿作品"的版权问题却使图书馆的数字化建设受到阻碍。对此,有关国家和地区纷纷立法,国际图书馆协会和机构联合会与国际出版商协会也联合发表了《孤儿作品使用原则》。我国图书馆对"孤儿作品"除享有合理使用、法定许可等权利外,做其他方式的数字化开发利用尚无完善的法律依据,但是其可以探索、尝试一些适度、有节制的、对"孤儿作品"版权价值不会构成明显负面影响的策略来突破版权壁垒,使丰富的"孤儿作品"造福于全社会。At present, libraries of every country collect a lot of ＇orphan works＇, however, copyright issues of ＂orphan works＂ hamper the construction of the digital library. For these issues, relevant countries and regions have legislations continousty, Intemational Federation of library Associations and Institutions and International Publishers AssoCiation also jointly published Orphan Works Use Principle. There are no perfect legal bases for the digital exploitatior on ＂orphan works＂ in Chinese libraries, except for reasonable uses. the legal permission and other rights. But Chinese libraries could try and explore some modest and abstemious stategies to break copydgh barriers. These strategies should not have the significantly negative influence on the copyright value of ＂orphan works＇, and could make ＂orphan works＂ benefit the whole society.
