论农地入股企业的产权配置——以农地功能及其价值构成为视角

摘　　要：农地价值包括质量价值、社会保障价值、社会稳定价值、生态价值和发展价值等,入股企业按照支付的价值不同而享有不同的权利,并免除相应的义务。农地入股实质是农地产权的重新配置,是以农地产权中的某种权利或权利束入股,入股企业按照取得的不同权利束来支付入股对价。农地入股流转是经济法权利与经济法义务的流转,是国家为规范农业经济的发展,从社会整体利益最大化的宗旨出发,协调利益相关者对入股农地的利益。农地入股的性质应该是一种受国家监管的经济调制行为。农地入股企业终止时,入股农民可支付相应的成本依法取回农地,使流入企业的农地权利束回归入股农民,农地产权重归完整。Farmland values include quality value, social security value, social stability value, ecological value and development value. The enterprise enjoys different rights according to different payments, and removes the corresponding obligations. In essence, shares of agricultural land is reconfigured by farmland property rights, which is the investment of a right or bundle of rights in land property rights. Enterprises pay for the prices according to different bundled of rights. The circulation of shares of a- gricultural land is the circulation of obligations of economic law and the rights of economic law, and the country＇ s coordination of stakeholder＇s paying for the interests of share agricultural land in order to regulate the development of agricultural economy and maximize the whole social interests. The nature of shares of agricultural land should be a economic modulation behavior of national supervision. When enterprises with shares of agricultural land terminate, shareholder farmers can pay the eorre- spending costs to retrieve land so that the bundle of rights flowed into the enterprise should be returned to the farmers and rural land property rights are complete again.
