越南农产品地理标志保护制度概况及中越农产品合作探讨

摘　　要：【目的】分析越南农产品地理标志保护制度,为加深中越农业经贸合作提供参考。【方法】通过对越南农产品地理标志保护产生和发展及越南地理标志保护管理体系关键点的介绍,提出中越农产品地理标志保护合作建议。【结果】中国与越南地理标志保护制度的形成受法国影响较大,越南农产品地理标志保护无论保护对象、注册程序等与中国专门法模式下农产品地理标志保护接近。但越南农产品地理标志的上位法是《知识产权法》,我国国家质检总局2005年6月颁布的《地理标志产品保护规定》是部门规章。从中越两国地理标志保护合作视角看,在Trips框架下构建两国基于专门法模式的地理标志保护体系是可行的。【建议】中越双方应在现有基础上建立地理标志保护对话平台和合作机制,分步实施、稳步推进,进一步推动中越农业经贸合作的发展,从而促进中越农业可持续健康发展。[Objective]The geographical indication protection system of Vietnam was analyzed in order to provide refer- ences for deepening agricultural economic and trade cooperation between China and Vietnam. [Method]Based on the analysis of current status of geographical indication protection system of Vietnam, the suggestions of deepening the agricultural geo- graphical indication protection cooperation between China and Vietnam were put forward. [Result]The geographical indication protection system of China and Vietnam was greatly affected by France. The geographical indication protection system of Viet- nam including protection object and registration procedure was similar to China. The higher-level law of geographical indica- tion protection system of Vietnam was intellectual property law, but it was regulation in China, which was Geographical Indi- cation Product Protection Regulation issued by General Administration of Quality Supervision. From the perspective of Sino- Vietnam geographical indication protection, mutual geographical indication protection system based on specialized law within the frame of Trips was feasible. [ Suggestion ]According to the current foundation, exchanges and cooperation mechanism between China and Vietnam should be steadily established step by step in order to promote the development of agricultural business cooperation between China and Vietnam and realize the sustainable development of agriculture in China and Vietnam.
