公益性项目征地补偿依据及其测算标准研究——以苏州市为例

摘　　要：现行征地补偿标准偏低,随着我国大规模基础设施等公益性项目征地数量激增,探寻合理的征地补偿标准对农民和项目建设具有重要意义。本文在文献回顾的基础上,从理论和实证研究两个层面分析了现阶段公益性项目征地补偿依据,补偿费的内涵、构成及其测算方法。理论研究表明,现阶段公益性征地补偿应采用"适当补偿"原则,补偿费是指国家按照耕地原用途及农民实际价值损失支付给失地农民个人的合理费用,具体由耕地的经济价值和部分社会保障价值构成。个案研究表明,本文建立的补偿标准和方法是符合"适当补偿"原则的:首先高于现行征地补偿标准,符合农民的受偿意愿,更好地维护了农民的土地权益,其次仍兼顾了政府的实际财政支付能力、经济可行性;修正的土地还原率,更能体现耕地真实的经济价值;独立测算的社会保障价值超过总补偿费的一半,耕地的非生产性价值不容忽视。在本文研究基础上,最后给出了未来征地补偿改革的政策建议:严格界定公益性征地范围、逐步采用"公正补偿"原则取代"适当补偿"、以"公平市场价值"为补偿费测算的基准。As the construction of large-scale infrastructure continues, there are increasing demands for expropriating agriculture land in China. However, the compensation standard is too low to meet farmers＇ needs and research into appropriate compensation standards for both farmers and projects is needed. Here, from theoretical and empirical aspects, we analyzed the compensation basis, compensation connotation, content of compensation and corresponding determining methods. The theoretical analysis shows that public purpose projects should obey the level of compensation for expropriation as ＇appropriate compensation＇ determined on the basis of （1）the value of land used for agriculture; （2）the amount of actual loss; and （3）amount paid to farmers. In addition, the compensation content comprises economic value and part social security value. The new compensation standard proposed here, considering the payment ability of government finance, is still higher than the existing one and better protects farmers＇ rights and interests. The adjusted ratio of income capitalization is lower than the generally used value, which is more accurate for the actual land economic value and increased accordingly. Social insurance values account for most compensation and play an important role in famers＇ lives and it is very important to calculate this part of the value alone. For future reform, the purpose for which land may be acquired should be clearly identified and legislative provisions should ensure that full market value is the basis of compensation for all land expropriation. Further, the owner and allocation of compensation should be clearly defined; the parameters in the economic value should be further researched; and compensation methods of the social insurance value need to be discussed.
