摘　　要：乘客与承运人订立的是运输合同 ,承运人承担保证乘客安全的义务。对于乘客在运输过程中的人身损害 ,承运人承担无过错赔偿责任 ;对乘客的财产损害 ,承运人承担过错责任。当乘客的损害是由第三人所致时 。The contract being concluded by the passenger and the carrier is a transpart contract. The carrier undertakes the obligation of guaranting the passengers safety. The carrier bears the liability without fault for bodily injury of passengers and the tort liability for property damage of passengers. When the passengers injury is caused by the third party, the carrier should bear the same responsibilities.
