摘　　要：通过对我国专利法律状态进行调研,阐述法律状态的定义、作用及其分类体系。以国家知识产权局专利数据库为样本进行实证研究,根据国际分类号(IPC)对申请量、授权率、授权时间、存活率、失效原因、终止时间、技术转化率、专利寿命等进行对比分析,以期为专利的保护和转化利用提供参考。Firstly, legal status of patents was investigated in China. The definition of legal status, its effect and classifica- tion system were analyzed. Secondly, patent database of SIPO was taken as samples. Based on IPC, some factors were ana- lyzed and compared, such as application quantity, grant, authorized time, survival rate, failure reason, termination time, transformational rate and patent life, in order to provide experiences and suggestions for protection and transformation of pa- tents in China.
