试论民族自治地方司法机关的特殊性

摘　　要：民族自治地方司法机关相对于民族自治地方的立法、行政机关而言具有特殊性,它不是民族自治地方的自治机关,不享有自治权,民族自治地方司法机关相对于非民族自治地方的司法机关也具有特殊性,主要表现在人员构成和工作原则方面。民族自治地方司法机关特殊性的存在具有合理性,对于维护法制的统一和少数民族地区公民的合法权益有重要作用。Compared with legislative and administrative organs in national autonomous areas, judicial organs have partieulafities. They are not self-government organs and don＇ t autonomy. Compared with non-autonomous areas, they also have particularities, mainly in personal sll-ueture and working pfineiple. Their partieulafities are reasonable, which is important for protecting the unity of legal system and people＇ s fight in these areas.
