摘　　要：企业安全生产风险抵押金因"不服水土"、"不能分散移转风险"致使保障安全生产责任落实的功能有限,该制度"押"不住危险。企业向职工收取"全员安全风险抵押金"的行为有摊派安全生产风险抵押金之嫌疑,该行为无效。安全生产责任保险比风险抵押金更具优越性,风险抵押金制度已经到了终结的时刻,必须废除安全生产法律、法规中关于风险抵押金的相关规定。For＂ refuses to soil and water＂ and ＂do not dispersed risk transfer＂ lead production safety risk mort- gage of enterprise not to guarantee the safe production responsibility to carry out, the function of the system is limited, and it doesn＇ t control danger. Behavior of Enterprise charging the worker ＂the safety risk mortgage＂ is suspected of apportion production safety risk mortgage, this behavior is invalid. Liability insurance of safe production is much more superior than the risk of mortgage, system of production safety risk mortgage has come to the end of time, we must abolish laws and regulations of production safety risk mortgage rules.
