摘 要:清真食品的界定包括清真食品的定义和标准两个方面,两者之间是抽象与具体的关系,相辅相成。现行地方清真食品管理法规对清真食品的定义采用的是风俗说和风俗与宗教结合说,立法中存在着定义模糊、循环定义等诸多问题。清真食品定义应当采取风俗与宗教结合说,以民族风俗习惯和宗教教规为基本特征和本质属性。清真食品的标准分为形式标准和实质标准,其中形式标准可以在全国范围内统一,而实质标准却不具备统一的条件,应当在制定省级标准的基础上,待今后条件成熟后,逐步制定国家标准。The definition of halal food includs both the the definition and standard, between of which the relationship is abstract and concrete., complementing each other at the same time. The current local regulations on halal food uses the doctrine of the mixed definition of customs and religion rule and the doctrine of single custom. However, there' re a few problems in the legislation,such as vagueness and circular definition. The doctrine of customs and religion should be taken in the legislation,regarding the ethnic customs and religious rules as the basic features and essential attribute of hala food. The standard of halal food includes the formal standard and substantive criteria.The formal standard can be unified nationwide, while the substantive criteria can' t be unified for lacking the condition. The substantive criteria shall be based on the development of provincial standards, developing to national standards gradually, when the conditions are rip in the future.
