摘 要:目前国家仍未放开土地承包经营权抵押政策的束缚,主要是因为土地可实现农村社会的养老保障功能,在社会稳定特别是农村社会稳定方面起到了巨大的保障作用,因此抵押风险(失地风险)是农户抵押中最关注的问题。随着社会经济发展和新农村建设的大力推行,在开展土地抵押试点时出现了许多不确定因素。分析了新农村建设案例,在运用土地承包经营权抵押获取建设资金时,如何利用Berman原理对影响因素的不断变化进行动态决策。At present, right to the contracted management of land mortgage for the country was still not on the open policy, mainly because of land could realize the function of the rural social old - age security. On the social stability, especially the rural social stability played a huge role. There- fore, the mortgage risk (ground) was the most concern in the peasant household mortgage. At the same time, with the development of social economy and pushing forward the new rural construction, pilot implementation in land mortgage, also appeared a lot of uncertain factors. It analyzed the case of the new rural construction, the use right to the contracted management of land mortgage obtained construction fund, for changing the influential factors of how to use Berman principle for dynamic decision - making.
