摘　　要：公共图书馆作为公众获取知识的场所之一,开展业务时必然会复制他人作品。然而我国《著作权法》未系统地规定图书馆的复制权例外,导致公共图书馆开展业务时面临诸多风险,特别是数字图书馆业务的开展。为使公共图书馆能合法开展其业务,应当以我国国情为基础,根据公共图书馆的职能和三步检测法,并借鉴国外先进的立法例,构建我国的公共图书馆复制权例外制度。In order to carry out its duties, public library must reproduce its collections. But there are no legal systematic rules of library exception to reproduction in our Copyright Law. Therefore, library has to infringe right of reproduction sometimes while carrying out its duty of providing knowledge to public. This is more obvious for electronic library. In order to carry out duties legally, system of public library exception to right of reproduction must be available in our copyright law according to our national conditions, duties of public library, 3 - step test and advanced experience from other countries.
