城市化背景下农村征地问题中的乡镇政府责任研究

摘　　要：乡镇政府在农村征地中责任缺失的表现:在征地过程中权力的滥用;土地征用范围过宽,政府寻租行为严重;在失地农民安置中的责任缺失;在保护土地资源和生态环境安全中的责任缺失。责任缺失的原因:政府权力的扩张性;政府角色的不确定性;缺乏有效的监督机制。对策:构建责任型政府;完善政府耕地目标责任制和责任追究机制;建立严格的监督机制;规范土地征收程序;增强农民对土地的处置权利。This paper analyses the responsibility defect of township government in rural land expropriation. These behaviors include：the abuse of power in the process of land expropriation, excessive broad in the scope of land requisition, serious rent-seeking behavior of the government, and the responsibility defect of township governmental both in the settlement for peasants who lose land by requisition and in the protection of land resources and ecological environment security. This paper argues that the reasons behind the responsibility defect lie in the fact that：the expansivity of the government power, the uncertainty of government role, and the lack of effective supervision mechanism. In response to this, this paper puts forward some measures： building responsibility-oriented local governments, improving government’s land target responsibility system and responsibility assigning mechanism, establishing strict supervision mechanism, standardizing land expropriation procedures, and enhancing disposal rights of farmers on the land.
