西方法治进程中参与式行政的理论基础探析

摘　　要：西方法治思想所蕴含的自然正义与民主等政治理念,孕育了欧美国家公众参与行政制度的萌芽。其参与式行政在西方特定的社会经济条件下产生与形成,并在近代经济学、哲学理论的论证与反思中不断发展完善。分析梳理西方法治进程中参与式行政的生成机理及演进脉络,探究个中的合理性与局限性,对于中国在当前国情下进一步完善公众参与行政法制模式不无裨益。The political ideas of natural justice and democracy, which was inherent in the western nomocracy thoughts, cultivated the western participatory administration system. The system＇s emergence was based on the specific western social economic conditions; its development was accompanied by western economics and philosophy＇ s improvement. Analyzing the participatory administration＇ s forma- tion mechanism and evolution context, meanwhile exploring its rationalities and limitations will be helpful to China to develop a reasonable participatory administrative legal system.
