摘　　要：被害人和行为人是多数刑事案件中必不可少的主体,现行的刑法理论往往只考虑行为人的刑事责任而忽视被害人的作用。而在实践中被害人对于犯罪结果的影响有时超过了行为人的作用,尤其是风险的自愿介入对犯罪构成和刑事归责产生重要影响。通过被害人风险介入的犯罪论体系构建,力求赋予被害人正当化的根据,使其真正被纳入到犯罪评价中去,从而构建行为人、被害人和国家三元化的犯罪评价体系。The victim and actor are two necessary subjects in the most criminal cases. Present criminal theory only considers the criminal responsibilities of actor but ignores the role of victim. In practice, the victim played more important role than the actor in affect- ing the result of crime, especially the voluntary risk intervention influenced the criminal constitution and culpability greatly. To construct the crime evaluation system with actor,victim and the state,we should construct criminal theory system on risk intervention of victim, give victim rational foundation to make it brought into crime evaluation.
