论物像权的独立价值与体系地位——由宠物“肖像”维权案说开去

摘　　要：物像作为物之外观在物质载体上再现的视觉形象,于其上成立物像权,具有独立的理论与实践价值。物像权是指法律主体对基于其拥有一定权利的物所形成的物像享有的直接支配的排他性权利。它与人格权、知识产权等并行不悖,不隶属于原物物权,而是一类独立的新型物权。由于物像与一定的人格利益紧密相关,属于人格物的范畴,法律主体就其享有的是具有诸多不同于传统物权之特征的人格物权。对于物像权,我们一方面可以根据传统物权理论的指导,通过它来实现物尽其用、保护人格利益和防止不法获利的价值,另一方面也应当在此过程中注意到物像作为人格物的法律属性,在适当的范围内承认物像权并划分其与他人权利之间的合理界限。Property portrait is a visual image of the property~ appearance reappeared on the material carriers, on which the right of property portrait is theoretically and practically worthy of creating. The right of property portrait refers to an exclusive right to directly dominate the portrait of some property, of which the legal subject enjoys some right. Paralleled with the right of personality, intellectual property right, etc. , the right of property portrait is a kind of new - type property right other than the property right of the original property. Owing to its close relationship with some personal interests, the property portrait belongs to personal property, and the right of property portrait is a right of personal property whose features are so much different from traditional property rights. As for the right of property portrait, on one hand, it could be used to make the best use of properties, to protect personal interests and to prevent illegal enrichments, under the instruction of traditional property right theories; on the other hand, it should be admitted within appropriate limits and reasonably distinguished from the others＇ rights, according to its legal characteristics as a personal property.
