摘　　要：渔业法是国家关于渔业领域的基本法,现行《中华人民共和国渔业法》大部分条文都是比较粗线条,已不适应渔业形式的变化,修正和增补其条款项内容显得越来越重要。基于国情渔情重构渔业法框架,写入渔业权和入渔权,明确渔业法的立法宗旨,廓清渔业相关基本概念,进而从事渔业法细化工作。这既是国外经验的启示,也是渔业法制走向健全的基础。Law of Fisheries is the fundamental law in the sphere of fisheries field. However, most of acts in the current law of fisheries in People＇s Republic of China are still rough and even out of date. Therefore, it is more and more important The essay aims to add fishing rights and common to revise and supplement the contents of the acts. of piscary, and to make the purpose of legislation and related concepts definite in order to refine the law of fisheries. It is not only the inspiration from foreign experience but also the foundation for a sound law.
