死亡赔偿金的反思与重构

摘　　要：现行司法实践中,死亡赔偿金是对收入损失的赔偿,其性质是财产损害赔偿,理论依据是继承丧失说。死亡赔偿金的语言表述词不达意,易被误读,引发"同命不同价"的争议;现行的死亡赔偿制度对生命权本身的损失没有补偿,违反完全赔偿原则。应当将现行的"死亡赔偿金"改称为"预期收入损失",保留"死亡赔偿金"称谓并赋予其新的内涵,实行平等赔偿、定额赔偿。The current judicial practice, the death compensation is the compensation for loss of income, its property is property damage compensation, theoretical basis is the loss of inheritance said. Death compensation language ambiguity, easy to be misread, caused strong dissatisfaction ＂with different price＂ ; The death of the current compensation system doesnt fill the loss of the right to life itself, in violation of the principle of full compensation. Current compensation ＂death＂ should be renamed the ＂expected revenue losses,＂ keep ＂death penalty＂ appellation and given new connotation, equal compen- satlon, quota compensation.
