电子票据设质方式探析

摘　　要：传统票据质押分为票据法上的票据质押与物权法上的票据质押,前者的设立方式是质押背书,后者的设立方式是"交付"票据,书面质押合同并非设立物权法上的票据质押的必备要件。票据法上的电子票据质押的设立方式是登记与质押背书。物权法上的电子票据质押的设立方式是质押登记。质押背书并非电子票据质押的一个必备要件,但它是区分票据法上的电子票据质押还是物权法上的电子票据质押的标志。The traditional bill pledge is divided into bill pledge in the negotiable instrument law and bill pledge in the property law, the establishment of the former is pledge endorsement. The establishment of the latter is ＂ delivery note＂, and a written pledge contract is not the necessary element to set up bill pledge in the property law. The establishment of electronic bill pledge is registered with the pledge en- dorsement in the negotiable instrument law. The establishment of electronic bill pledge is registered on e- lectronic bill pledge in the property law. Pledge endorsement is not an necessary element of electronic bill pledge, but it distinguishes the electronic bill hypothecation in the negotiable instrument law or the elec-tronic bill pledge in the property law.
