从一份吐鲁番文书看唐律的变化

摘　　要：LM20-1457-20-01、大谷5098、8099号《贼盗律》残片的制作年代为载初元年(689)至神龙元年(705)武则天当政的武周时期,反映了一种与《唐律疏议》第294条不完全相同的关于卖期亲卑幼的律文。从《贼盗律》残片所反映的武则天时期的唐律及其疏议到《唐律疏议》,唐律及其疏议显然是有过变化的,而且这种变化既涉及形式方面,也涉及内容方面。同时,《贼盗律》残片与《养老律》《唐律疏议》的异同,也折射出从永徽律疏到《唐律疏议》的递嬗演变,为《唐律疏议》系开元律疏的说法提供了有力支持。LM20_1457_20_01 and Otani 5098 and 8099 fragments of Offences against the Person and a- gainst Property was made in the period of emperor WU Ze - tian from the first year of Zaichu to the first year of Shenlong. It displays an article different from the article 294 of the Tanglii Shuyi （《唐律疏议》） and reveals an unknown evolution of the Tanglii Shuyi. It also become the most important evidence of the viewpoint which claims the Tanzlti Shuvi was made in the Kaiyuan period of Tang Xuanzong.
