法治维度下基层维稳机制理性建构的路径探析

摘　　要：法治是实现基层维稳运行机制理性建构的制度保障。法律至上、良法之治、人权保障、公正司法等法治维度下的基层维稳机制应成为其理性运行的内在制度逻辑。从理性建构基层维稳机制的基础看,法治有利于提升基层政府的维稳能力;从理性建构基层维稳机制的条件看,法治有利于有效引导公众的维权行为;从理性建构基层维稳机制的保障看,法治有利于有效约束基层政府的维稳权力。Rule of law is the base of maintaining stability of system guarantee mechanism of rational construction.The dimension of the supremacy of law,good governance,human rights,justice and rule of law under the dimension stability mechanism,should be the rational operation of the internal logic of system.Foundation for the construction of basic stability mechanism from a rational per- spective,the rule of law is conducive to enhancing the ability of basic level government dimension stability.Construct the basic sta- bility mechanism from the rational conditions,the rule of law to legal action effectively guide the public.Construct the basic stability mechanism from the rational security,rule of law is conducive to the stability of power constraints of grass-roots government.
