我国竞技体育纠纷仲裁机制缺陷与司法审查的介入

摘　　要：当前我国竞技体育纠纷存在主要两个矛盾:一是价值层面,体育自治性、特殊性与体育全球化、体育商业化在利益诉求特点上的差异与矛盾;二是操作层面,竞技体育纠纷仲裁与行政诉讼孰轻孰重的矛盾.这两个矛盾的凸显导致我国竞技体育纠纷仲裁机制显现出以下非常特征:竞争性过于突出而使仲裁范围相对狭隘且依据模糊,垄断性过强而排斥司法介入,仲裁效果上则公正性受质疑且合意性不足.针对以上矛盾和缺陷,有必要进行司法审查,并对我国竞技体育纠纷仲裁机制进行制度创新:协调与礼让是促使各方达成合意的前提与上佳选择;独立仲裁与司法审查合理分工是重点;确保仲裁机构去行政化是难点;改革体育体制是一个绕不过去的根本问题.而确定责任认定和损失评估标准、完善体育纠纷风险基金制度是抓手.There are two main contradictions of sports disputes ： in the value level, differences and contradictions between sports autonomy, the specificity and sports globalization, commercialization of sport in the interest demands; in the operational level, contradictions between competitive sports disputes arbitration and administrative proceedings. These two prominent contradictions cause following shortcomings of sports dispute arbitration mechanism： relatively narrow scope of the arbitration and based on fuzzy-permanent, the exclusion of judicial intervention because of the ＂industry autonomy＂, the arbitration in question and the lack of consensus. For the above contradictions and defects, it is necessary to intervene in judicial review, and dispute arbitration mechanism of competitive sports need reconstructed： emphasis on eonsensual choice of sport arbitration, to ensure the legitimate interests of stakeholders; establishment of the specialized institutions of sports dispute arbitration and rational division of judicial review; transplant of mature model legislation to ensure that arbitration body out of administrative trends; responsibility identification and loss assessment standards, and improving sports disputes risk fund system as a necessary complement.
