摘 要:对食用农产品致消费者损害的侵权案件,食用农产品的生产经营者应承担何种性质的侵权责任,我国立法并不明确,理论研究也不充分。通过对食用农产品侵权责任法律性质立法例的考察与分析,产品责任立法中的产品是否包括食用农产品是由农业生产力发展水平决定的,也是立法者对生产者与消费者利益衡量的结果。依据马克思主义法学对法律制度进行价值分析的评判标准,应当修订完善我国目前的立法,明确食用农产品侵权责任的法律性质为产品责任。As for the tort legal cases on edible agricultural products which causes damages to consumers, the current legis- lation is not clear on what kind of tort liabilities the operators of edible agricultural production should undertake, and the theoretical research is not sufficient. Through the study and analysis of the cases and legislation concerning with the legal nature of the tort liability of edible agricultural products, whether edible agricultural products are included in the definition of products or not is decided by the level of development of agricultural productive forces, as the measuring results made by legislators to balance the interests between producers and consumers. According to the criteria of the Marxism jurisprudence on the value analysis of the regime of law, we should revise and prefect the current legislation, and define that the legal na- ture of the tort liability of edible agricultural products is the product liability.
