摘 要:对家庭教育进行法律规制是规范家庭教育的有力手段,亦是法发挥社会功能和作用的体现。通过实证分析法总结归纳我国现有的家庭教育法律规定。使用具体的问题分析法,确定现有家庭教育法律存在的问题,进一步分析导致这些问题的各种可能因素。从事前的思想与内涵、事中的当事人、事后的追责几个方面入手,对现有家庭教育法律进行规制,利用国家强制力引导我国家庭教育科学发展,使其成为提高儿童自我保护意识和能力的第一道有效防线。The legal regulation of the family education is not only a powerful means to regulate the family edu-cation,but also the embodiment of the law played in the role of social function. The paper summarizes China's current family education law by empirical analysis,identifies existing problems,and then discusses the possible factors for these problems. The current family education law may be regulated from thought and connotation be-fore the event,person concerned during the event and accountability after the event. The paper finally maintains that the scientific development of family education must be achieved by national compulsory force,and family education law must be made the first effective defense for improving children’s consciousness and ability of self-protection.
